Gratuity and NOC issuance

Hello Everyone,

I am in a spot of bother. My current company which is based in Qatar has given me an opportunity to relocate to dubai ( I will we working under the same company ,but on dubai project). For this to happen, they want me to cancel my qatar visa and then go to dubai.

My question is :

1. Even though i will be working under the same company, is it ok for me to ask for my gratuity amount for the years worked in qatar before I exit qatar? Or will the gratuity carry forward to dubai - I want my gratuity money for the years worked in Qatar.

2. Can i ask for an NOC in Qatar since my company is cancelling my Qatar visa ? If there is a chance  for me to work in qatar in the near future i can use the NOC (As my current contract in qatar is open ended i.e 5 years) - Asking this because I am not confident if my company will provide me NOC

Need your help guys. I need to sort out the above two queries before I leave qatar.

Thanks a lot for your advice guys. I spoke to the PRO services today ,they told me as per Qatar labor law i will have to claim my gratuity amount before leaving Qatar.

ashokstar: What if his company in Dubai refuses to give him his gratuity for his service in Qatar? Can he claim it in a court in the UAE? I guess he will be simply stuck up with an empty hand and unable to do anything.

Gratuity is given after resign/ termination so you are not eligible.

Before you exit Qatar, it is advisable for you to take your gratuity and other benefits from the company. Qatar and the UAE are two different countries and have their own laws which are applicable in their own countries. The issuance of NOC is entirely at the discretion of your company. You can try to get one but if your company refuses, to my knowledge there is nothing much you can do about it.
