Can I proceeds with Legal Action?
Dear Sir,
I am a Qualified Accountant with Degree in B.Sc.Business Administration (Finance) Special. In March 2005, I came to Qatar with an employment visa of a local Company as an Accountant. Due to practical difficulties prevailed on that company, within a month time; I managed to get the release by paying additional amount of money and joined with another local company, which is my present employer.
Presently I am working for this company more than Three years. As my current employer is paying a very low salary when compare to Market rate, and not increase the salary even after two years of services, I decided to seek a better offer in Qatar itself, beliving that I could easily get the release since I have been recruited locally.
Recently I was offered an Employment offer in a well reputed listed company in Doha with a very attractive remuneration package, which is four times higher than the present salary package. When I requested release from my present employer, he refused without any valid reason.
Dear Sir, due following reasons, can I get legal advice for release?
• As I am not directly been recruited by my present employer,
• There is no fixed contract between me and employer except the Letter of Appointment,
• I have been working for my present employer for more than three years,
Due to above reason, can get the legal advises and file a case againt the sponcer?
I think you can Ask for release.
Change of sponsor possible with agreement and NOC of present sponsor/employer only. Remember now they need NOC from 'previous sponsor/employer' even if you decide to quit and wish to re-enter Qatar at a later date. Try amicable settlement.
That is a waste of time, you loose as your employer got the rights, not you.
Get over it, resign and leave the Country. Get a job in UAE for example.
You are stuck forever if your present employer is your sponcer. No legal action available in this case.
