If ure really interested, u might want to approach the "mandoop/PRO" of your present and new company to see if the application will go through. Most often, mandoops with a good "hold" on the ministry officials can get it done for you effortlessly.

I think, the best remedy is to consult the authority directly(i.e. Ministry of Labor, et. al.) about the actual policy.
