Regarding NOC

I like to start a discusion regarding NOC in Qatar..Most of the people dont have ideaabout NOC.. Many employes simply cheeted by the companies becoz of this lack of knowledge regarding NOC.

I want to know how I will get NOC from my employer??

Can I ask my sponser to NOC if i get termination letter?

What are the conditons for terminating an employee?

Dear Friend, I am also in the same confusion and still searching for the right and authentic answers. I too got terminated from my company and it had written that "due to excess manpower" and still i could not get N.O.C after pleading to him. Moreover they are trying to cheat me by holding some of my settlement dues for which they are not interested to give back. I had even put in prison in abscond case for 2 days and really it was a big torture, since my family is at home. Since, i have filed a case against my boss / company legally , i came out from hell. My second hearing is nearing and I'm still not sure about the other irrelevant charges the company can attribute to me for his winning. please give suggestion and opinion for this too....

No....there is soem more reasons to terminate an employee with out any specific reasons...But the boss will simply tell unsatisfied performance or something.

Some of the Boses getting comminsion from the recruters if they recruit new emplyoees...:(

For getting this benefits soem Boses are doing this termination drama...Here most of the emoployees are innocent..:(

But they may get termination for getting benefits to the Bosses..

Is there any loop point to get NOC such cases???

Really its very sad and bad...:(

1. NOC is solely on the discretion of the employer..No one can force its boss/employer to provide NOC..

2. Yes, you can surely ask you boss for NOC..But don't expect to get positive answer in return...

3. There could be many reasons for termination..Like, the performance of an employee is not upto the mark or an employee has cheated in financial aspect of a company etc etc..

Really Qatari Labour Law is good for companies..Its not supporting Labours..:(

BUT do you have the means and money to pursue a court hearing? Do you have the means and money to survive while awaiting decision? If your answer is yes, then go to labor court! Who knows, you win?

Most of the companies dont like to issue an NOC...In that case they can mention simply that nonsatisfied performance rite? Its not fair...Is there any loop point to get NOC such cases....?

I rather doubt that a company would issue an NOC for an employee whose performance they said they were dissatisfied with. It would kind of negate the "No" part of NOC.

Suppose I am getting termination and telling in that letter like company dont want ur service due to recession or something.

In this case most companies will give NOC. But some companies are not willing to give NOC on this case also. Is there any hope if the employee will go to Labour court in this type case????

Also one more thing.. Termination letter teling that terminated due to unsatisfied perfromance...Is there any hope in this case?..

You should ask for an NOC BEFORE you start working with a company. Tell them to leave the date open, but make sure it is signed and stamped, and that you get a computer registration of the company with the authorized signatures. THEN you can sign your contract and hand in the passport for the visa procedures.

I agree with what MySense had mentioned...it's company's discretion, in short if the company doesn't want to give you, you can't do anything in terms of legal matters, however, of course their were special cases that the company were obliged by Labor Dept. to give NOC to the complaining employees. Due to some major reasons or a win win solution to resolve a conflict. This would probably after a years of conflicts...complicated right? I hope this will help you...

In my own little knowledge NOC is not a mandatory document to ask from employer, they will give you NOC if you dont have any case against them. But in some cases like if you are resigning becoz you got an higher offer within Qatar or GCC country, in that case most employer will not issue NOC and it is the company discretion. And if you are terminated with caused (ofcourse) maybe no chance for NOC. For complete knowledge with your current employer, review and understand your contract.
