What are employee's resignation options during probation?
My friend came to Qatar 3 months ago on a visit visa and was hired locally and has now worked for a month under the sponsorship of that company. The company is working on his residency permit and he has got a much better offer from another company that he had applied to. His current contract is of unlimited duration with a probation period of 6 months.
The Labor Law states the employer can terminate the contract during probation by giving 3 days notice but it is silent on the options of the employee in terminating the contract during that time.
What are his options and has anyone been in a similar situation?
Many thanks.
Resign and go back to your home country before the processing of RP stamping.
You can come back to Qatar under the new sponsor's visa, without NOC from the prevoius sponsor.
Shaniyas your right that's why there keeping it the way it is, because we people don't have a satisfaction in life in the first place why your friend sign a contract on this company if he/she not sure about it.
You/your friend, have no chance of getting an NOC from your/his employer since you/he has been hired and have worked under their sponsorship for a month.
Of-course, you/he can terminate the contract by giving a resignation letter as you/he is still under probation period. But remember, you/he; is already under their sponsorship and it is
their discretion whether to release you/he under the circumstances..
I i strongly believe, there is a "NIL CHANCE"
Yes, can resign but the bigger issue is the NOC. If he has just come into the company and they are working on an RP I doubt they'll be too happy to provide him with an NOC to work somewhere else.
