End of service gratuity and non paid salaries
Hi all. I have been working with my current employer for four years and a half now. In the last five months I haven't received my salary from the month of May 2018 to be more precise.
My question is centered on the action that I have to take and the effeciency of that. Shall I resgin and sue them ? but I am afraid I would be wandering in a vicious circle of endless costing legal prcedures.
In the event of submitting my resignation, asking for my unpaid salaries and end of service gratuity and returning back home. would this pressure my employer to release my entitlments knowing that the company is black listed now and the accounts are 0000000.
Please advise and help me find a way to flee this very pressuring situation.

I don't understand companies "not having funds" isn't WPS supposed to hold an amount per company to take care of this - for people out of frustration resigning and leaving.
What about the article by FIFA denouncing Amnesty about laborers not being paid for months?
Yes, it takes quite some time. It may take you around 4 months to get the court to order the company to pay and even then as I hear, they don't pay. During this period you don't have a job but your expenses are there. It is better for you to go home overlooking the sad the part of life. And in your case, as you say the company has no money at all. How will they pay you?
Actually I am willing to submit my resignation and go back to my home country for good.
I will confirm this to the labour department.
Shall solving the dispute take time in this situation ?
Better to settle what ever amount and leave immediately. Because otherwise have to waste your valuable time without job or proper income
Me too faced same situation. I went Labors Dispute Resolution Committee in front of City Center. In month of March Got the judgement within within two months. Now it's in judgement execution court. Its take time if sponsor or company representative if not appear.
