Final settlement after 2 yrs of contract

HI,
I have need a help in clarifying .
I have worked for last 2 years +3 months. As per contract or agreement it is 2 yrs renewable.

1)When i worked for 2 yrs 4 months they said to continue for next 1 or 2 years they will give 42 days leave salary + 14 days per year gratituty+ 42 days leave with 2 way ticket.

2)If i am not going to continue will they pay me 42 days leave salary +14 days per year gratituy +1 way ticket & what will happen 42 days leave which they are giving if i return . will they pay salary for that again apart from 42 days leave salary.

3) If i work for 2 years 4 months and not going to continue will they calculate leave salary and gratituy for 2 yrs 4 months or only for 2 years?

Please help clarify .

you are entitled for 21 days per year as gratuity and 21 days per year as leave salary, they will calculate it as per the full period of service as per days..you want to continue they have to encash your leave salary, and keep your gratuity till you leave for good. check with your contract is it stated as unlimited or two years contract,

for contracts there is no more play arounds it is coming from the ministry of labor, just we write the employee data and thats it,

I think the minimum is 3 weeks salary per year pro rata.

That is 7 weeks gratuity. Leave is also defined as a minimum, but depends on what your contract says.

However the guys you are dealing with have only one goal in mind, saving one riyal for the company justifies their existence! They will try to use any trick to fool you, what else can they boast about when they get together. Go straight to the labour department for an opinion on what is due to you, this will take a little time but you will gain money almost certainly.

If you work for a big (read established) company, then they would have a 'Compensation Manual' which defines all these rules.

Two answer your first question, the 42 day leave salary will not be paid as you have not earned it yet. You would earn it by returning and continuing to work (another year?)

I don't know the answer to your question about gratuity. In most companies the rule is "1 basic pay per year of service, pro-rata". So am guessing in your company it would be pro-rated as well.

ideally they should pro rata your leave. however, you will only find out by asking them.

Basically these contracts made are tricky, every company has there own write ups and contracts and not that they go as per law..

and being an employee you cannot fight on it if you are an expat..
