Gratuity - Need advice

Can anyone give a good advice on

I am working in a company for 8 years from 2004. I went on cancel after 6 years to change my position and came back in 3 months with new visa.but i didnt get graduity when i am going on cancel. Now I want to go again on cancel, Please advice me, that will I get gratuity for 8 years or only 2 years. If they dont pay me for 6 year, is there any possibilities for legal action,Your valuable advices highly appreciated.
