GRATUITY problem

my company is already closed/ bankcrupt last 31st july 2012, now i decided to go back home for good this 11 of august, but the thing is our salary is delayed for 3 months..the owner of the company is sheikh (not to disclosed) and they told they will give all our dues of all the staff and labours, until now havent receive. i work in the company for 5 years, they told they cant give our gratuity anymore because of too much losses.my gratuity would range around 12k to 13k QR based on labour law standards. The question is do i have a chance to get my gratuity on our case??? how??
i need your opinion please and comments.

I think coming to Qatar is little risky specialy coming to private sector its either doctor, nurse or executive class. Compare to other place in gulf Qatar is little uncertain place. Usually employee not getting salary on time and on leaving employers are not willing to give the gratuity and other end of service benefits. In my view before taking any risk of coming to Qatar better explore some alternative. and cost of living very high. So be carefull before joining any private sector and once you join, you will not be having much options.

Moza is right my friend..u may wanna charge this one to experience..or face much stress & tensions..as Pirate is saying Law maybe not on ur side..One thing im sure no place like home..
if i file a case or complaint from the labour law office, mybe it wont work because of my sponsor.
this is really sad... after long 5 years of work, and its written on your contract that an employee/ labour should be receiving gratuity after 2 years contract,... 12,000QR is not a small amount that just let it go or forget because u work hard for it.i dont want to cause delay or trouble in the end that i wont recieve anything if a file case is done.
If it is a Limted Liability Company you will have to join the list of creditors. Try and file a case but you may have to put this one down to experience.
You must File a Case and it may take time , though the verdict will be in your favour. Ask your boss if the company had done very , will they share the profit with you?. The rule here is simple

I am so sorry! This is a travesty and a tragedy. But if you file a court case you will not be able to leave Qatar for months or more. And you will not be able to take a new job. It's a terrible system.

BUT I THINK THEY WILL NOT GIVE YOU UNLESS UNTILL THEY R PRESSURISED BY GOVERMENT OF QATAR.
AND FOR SHIKH QATAR GOVERMENT WILL NOT DO ANYTHING AGAINST THERE CITIZEN.
File a case. The "law" is on your side. Or maybe not.
