LABOR LAW.. PLEASE HELP ME!!!!

IM WORKING HERE IN DOHA.. I FINISH ALREADY MY ONE YEAR OF WORKING AT MY COMPANY,, I NEED TO GO BACK TO MY COUNTRY FOR SOME OPERATION. I HAVE 2 YEARS CONTRACT.

SO MY QUESTION IS..??

CAN I GET SOMETHING COMING FROM MY COMPANY??
BCOZ THEY'VE TOLD ME THAT ONLY MY GAURANTEE FUND WILL BE USED TO MY AIRFAIR TICKET GOIN BACK TO MY COUNTRY,..

I THINK THAT IN QATAR LABOR LAW,, THE COMPANY SHOULD PROVIDE MY AIRFAIR TICKET THEN THEY WILL GIVE ME BACK THE GAURANTEE FUND THAT I GAVE TO THEM..PLUS THE SALART THAT I WORK FOR THEM..

PLEASE ANSWER ME.. THANKS A LOT .......

I agree with Sabish Babu. This whole "guarantee fund" business sounds illegal. While the law says your employer is not obligated to pay you any end of service benefits if you do not complete 2 years with your employer (it might be 1 year, don't quote me on this), your employer is not allowed to take any money from you - unless you were paying back a loan that you took from your employer. In that case, the law limits how much percent of your monthly salary the employer can deduct (I believe it is 10 or 15%).

On a parallel subject, it has become rather common for recruitment agents to ask the potential employee for a payment or a guarantee - "in case they are terminated or they quit before they complete the contract or probation period".

As far as I know, that is ILLEGAL in Qatar.

1. Its illegal to take any gurantee fund to collect from the employee. You can claim for fullrefund of it (what ever written agreement is there, company will be fired by Labour Law) 2. You are entitled for return ticket & end of service money on condition that you have to keep 1 month notice period (Qatar LL article 49, 54)

read ur contract! in our company if u have a 2year contract then u just finish 1year the return ticket must purchase by the employee. the guarantee fund or the bond i think it the saving or a fund by you to the company, for example now that u didnt complete your contract this fund will purchase for your return ticket ticket. the company must be liable to pay for your last salary or the recently number of days that u work. and i think they have also must pay the 21days equiv of ur salary. hope it can help!

i thought no body will answer my question>> but i really appreaciate ur answer..

that gaurantee fund that they took from us is our 1month salary.. they've said that this will be use if ever we were been cancel or resign... (we dont know about this when tha time they hired us in our country,, when we arrive here that tha time they took it from us,we cant do anything coz we already here) its jus like our saving here in this company(gaurantee fund)

coz we have one story into our company that one kenya girl finish here one year and then she resign.. she ask for tha computation of what she can take into our company our company told that she will not take anything except from here salary.. the gaurantee fund that they take to her will be used for her plane ticket,,,

and then she went to labor law office.. she ask for some assitant.. and from that she found out that tha company is liable to pay for here ticket goin home and tha gaurantee fund that they took from her will be given back to her plus tha salary..

im not sure about her contract coz shes been hired direct from dubai..not like my case they hired me at my country and i have 2 years contract... please help me more about my case..

is there any possibilities that i can get something from my company jus like they will pay for my ticket and they will give back my gaurantee fund..??

actually i resign to them...they dont know that i will be havin operation back home..

what do you mean by guarantee fund? first time I've heard about these term here. If you mean by this is bond then you are not entitle to get this if you will not finish your contract.

Second, if you have operation need to do back home, you need to secure health certificates or second opinion from doctors here that it is really life and death situation and you have to have the operation and this should be justified why it should be in home country and not here.

Third, considering that your companies agreed with you leaving for operation and with promise of coming back afterwards you are only entitle for unpaid salaries, 1 year leave which is 21 days, and one way ticket.

But, pray they would be considerate and kind enough to give you 2 way ticket to comeback here and that guarantee fund you are saying.

i didn't understand what u meant !!!!!!!!! what kind of guarantee money u paid to ur company. For airfare it solely depends on your contract u signed upon arrival. if it is airfare with paid leave after two years, and u want to quit after one year all u can get from company is end service benefits for one year that is equvilent to 21 days of ur salary, ur all outstanding salaries, salary against one month paid leave (if u have completed 12 months). u have to buy ur own ticket to go back. If your company insiston not to pay any thing on all of above you can contact human rights commission they will help you out in getting all the benefits u r eligible for...
