Qtel holds 25% of salary for outgoing staff.

I will be leaving my employment in Qtel soon.

I have also been told verbally by HR that Qtel will hold 25% of my last settlement payment (final month salary + leave days unused + yearly gratuity), and shall bank into my home country account 2 months later.

This rule is not stated in my contract of employment nor offer letter when I accepted the posting.

Question.

1. Is this legit for all companies in Qatar by labour law for expats?

2. What guarantee I have if Qtel does not release payment 2 months later? There is no legal rights to claim it when I am no longer tied to the company + no black and white.

3. What can I do to protect my interest?

Any advises will be most welcomed. Worked in many countries around the world, and this is the first time facing this situation which seems unorthodox in business dealings. Thanks.

Trust is the only option u have...........

And Qtel will not break ur trust as I believe....

It is illegal according to the Labor Law! Article 70Any part of the wage to which the worker is entitled may not be attached and the payment thereof may not be withheld except for the execution of a judicial decision. Article 67If the service contract is terminated for any reason the employer shall pay the wages and other sums to which the worker is entitled before the end of the day following the day on which the contract terminates unless the worker has abandoned the work without giving the notification provided for in Article 49 of this law. In this case the employer shall pay the wage and other sums to which the worker is entitled within a period which shall not exceed seven days from the date of the worker abandoning the work.

If this is a company policy then we can't do about it, however, if this is a new policy, you should not be governed by it. only those new employees. make sure to settle all your liabilities before you leave qatar for good.

You may also refer this case to the labor department for clarification.

QTel is a reputable company, please don't worry and trust them.  I'm sure they have a good reason for this, one of which my guess is---as arrear in case you may have an outstanding liability for which it could be offset with.  For assurance, gather all important documents prior to your exit.  Godspeed...
