If I get NOC from my actual Employer after 5 years - I have the right to claim my End of Service Benefits, coz it's a lot and I don't want to loose that.

I am laughing with the answer of "Harry Budianto" and about his knowledge, if you still work with them who needs end of service?!!

You are eligible to get your end of service from 2005 period, (Strict labour law implimented on 2005 only) rest of the year up to the management, it is your right to get end of service, if you approach Labour committe, who ever is your employer "they will arrange to pay you as per labour law" 21 days salary per year.

It depends on your sponsor bro. if he left no choice to you to select either gratuity or NOC you have to choose only ONE. ( NOC would be better ) best of luck.

YES BRO U HAVE RIGHT TO ASK FOR THAT AS U HAVE COMPLETE THE COMPLETE 5 YEAR OF UR VISA WHICH IS AS PER LABOUR LAW U CAN ASK FROM THEM WHILE U CHANGE UR SPONOSOR SHIP I HOPE THAT WILL HELP U HAVE TAKE MR YUNUS

I think Yunus has been armtwisted by the Sponsor saying that "Younus, if you ask for NOC, I will not give you End of benefits"

see, here Younus should not go for fighting. He may get the End of Service benefits, but Sponsor will not give the NOC.

Now Younus has to decide which is better for him.

You will get end of service benefits for sure as it is the labour law. NOC depends on the willingness of your Sponsor/Employer as it is not obligatory.

'End of Service Benefits' is like bonus from your company, but it's only can be gifted for the employee while you are still work with them (at least the end of your project/retirement), not after 5 years resigned.
